Before making your reservation, please carefully review the Terms & Conditions outlined below. Any reservation made with Indelible Mark Travel constitutes a binding agreement signifying your acceptance of, and your agreement to follow, these Terms & Conditions, and to be bound by them.

Please ensure that you carefully read and fully understand these Terms & Conditions prior to booking.

ROLES AND RESPONSIBILITIES

Through it’s affiliation with Nexion Canada ULC, Indelible Mark Travel is a registered travel representative with the Travel Industry Council of Ontario. Indelible Mark Travel is not a hotelkeeper, sightseeing tour operator, or transportation operator, all these services are provided by independent companies, herein known as service providers/suppliers, over which we have no control. Indelible Mark Travel’s obligation towards the traveler is to make a reservation with the service provider and issue the payment for the service when due, prior to the traveler’s arrival. Since we have no control over the service provider, we cannot assume responsibility for any errors, acts, or omissions by the service providers, their employees nor any other person over which Indelible Mark Travel has no direct or immediate control. We will, however, give assistance in good faith to resolve any such disputes you may have.  In return, you agree that Indelible Mark Travel will have no liability for inconvenience, injury, delay, airline schedule changes or cancellation due to war, riot, terrorist activity, natural disaster, sickness, weather conditions, airport regulations or other circumstances considered Acts of God.

BOOKING AND PAYMENT

Professional Planning Fees: A non-refundable professional planning fee is due at the time you request a travel quote.  This planning fee includes quotes for a general travel package which may include round trip-air, hotel accommodations, transfer to and from the airport, hotel, and pre-planned destination tours, complex trip planning, or multi-destinations trip, or event. Fee schedule will be provided upon request.

Trip Pricing: Price quotes for your trip are applicable to the date and time when they are requested.  This pricing may fluctuate due to your change of plans and/or foreign exchange rates.  No reservations are made and are subject to availability until time of booking.  Inventory and rates are always changing.  Quoted prices are not confirmed until a deposit has been paid. You are responsible to ensure payments are made by all payment deadlines to secure quotes rate.   This contract permits price increases.  No price increases are permitted after the customer has paid in full.  If the price increase is more than 7% (except increases resulting from an increase in retail sales tax or federal Goods and Services Tax or Harmonized Sales Tax), the customer has the right to cancel the contract and obtain a full refund.

Travel Insurance: Your travel plans carry cancellation and change penalties of up to 100% of your trip cost. We strongly recommend you purchase travel protection to provide cancellation and interruption coverage as well as emergency medical expenses, emergency medical transportation, lost or damaged baggage, and more.  It is your responsibility to read and familiarize yourself with the details of your travel protection policy coverage. Your questions above coverage should be directed to the travel insurance company.

CHANGES AND CANCELLATIONS

We offer products and services provided by third-party suppliers.  These suppliers are owned and operated independently, and we do not set, nor control the suppliers’ terms and conditions, cancellation, or changes.  Therefore, per these terms of service, you assume all risks when booking with the supplier and may not look to Indelible Mark Travel or Nexion Canada for any losses or claims resulting in injury or harm resulting from travel services provided by our third-party suppliers.

We will provide the supplier’s terms and conditions to you and help clarify any terms that are not clear and explain any cancellation or refund policies. By booking with the supplier, you have acknowledged and accepted the supplier’s terms and conditions.

Client Cancellation: Any changes and/or cancellations by you will be subject to the terms and conditions set forth by the supplier and will be subject to cancellation change fees payable to Indelible Mark Travel.

Changes/Cancellation Fees:

Once you reserve your tour, changes are possible, subject to availability at the time of your request. Requests for deviations, dates, changes in class of service, cancellations, and corrections are subject to applicable fees incurred by the supplier and Indelible Mark Travel.  You will be advised of the additional charges before Indelible Mark Travel makes the final booking. Indelible Mark Travel requires all changes to be made in writing (via email). No changes will be made without written consent.

Our fees:

  • Cancellation Fees: All trip and insurance cancellations are subject to a $150 cancellation fee per person. This will be automatically charged to the credit card on file. 

  • Booking Modification: All booking modifications (on an existing booking), including new dates, ship, resort,  are subject to a $50 per person change fee. This will be automatically charged to the credit card on file. 

  • Name and Birthdate Changes: Corrections to names or birthdates as a result of the failure of the traveler to provide the exact information as on passports, are subject to a $75 per person change fee in addition to any change fees assessed by the tour operator or airlines.

TRAVEL DOCUMENTS

It is your responsibility to inquire, and obtain, all required travel and health documents.   Note that the documents or other requirements for the outbound portion of your travel may differ from those required for the return. Along with the standard travel documents needed to enter Canada, additional requirements may be imposed, including additional documentation, depending on your country of origin, even only for the purpose of landing in Canada and re-boarding a connecting flight. 

Any adult travelling with children may be required to show evidence of parental/custodial and/or access rights.  Foreign and Canadian authorities may also require evidence that the adult has the consent of both parents, legal guardian, and/or the court to travel with the children. Some countries may not permit children to enter or, in some cases, leave the country without proper documentation such as a letter of consent or court order.

It is recommended that your passport be valid for at least 6 months after your scheduled return date.  Canadian citizens born in certain countries may require a visa in addition to a valid passport.  In all cases, identification must match exactly with the full name on all travel documents.  It is also essential that you examine your passport well before your travel date to ensure that it is not damaged in any way.  Passports with even minor damage may be rejected resulting in your being denied boarding for flights and possible forfeiture of your holiday.

Indelible Mark Travel or Nexion Canada is not responsible for any missing or inappropriate documents or failure to meet the necessary entry or transit requirements. Failure to meet the necessary requirements, including presenting the proper travel documents, may result in denied boarding and automatic cancellation of your reservation without refund. STANDARDS AND PRACTICES

Living Standards: Living standards and practices outside of Canada and the USA may be different. Such as and not limited to: sanitary conditions, hospital availability, health and medical care, local accommodations, transportation, electricity, food preparation and water quality. Indelible Mark Travel shall not be responsible for any claims, costs, damages, expenses, injuries or losses resulting from these differences.   For an up to date report on the country, visit the Canadian government website at www.travel.gc.ca 

Health: Safety, medical and security conditions may change between the date of booking travel and departure date.  Consult a health care professional or visit a travel health clinic preferably six weeks before travel.  Be prepared. Do not expect medical services to be the same as in Canada.    Please visit the Canadian government website at www.travel.gc.ca

Accommodations: Hotel ratings are based on the visiting country’s ratings; standards may vary from North American standards. Accommodations are with private bathroom facilities (toilet, shower and/or tub). A “double room” (one bed) – may have twin beds, that is two smaller beds substituted for the one bed. Hoteliers have the right to make certain changes to their property; such as they may choose to improve or maintain the property without notice. Indelible Mark Travel cannot be held responsible for any inconvenience.  Furthermore, if due to circumstances beyond Indelible Mark Travel control, the hotel fails to provide the reservation, Indelible Mark Travel or its agents have the right to provide accommodations of a similar or higher category.   Local taxes and fees may be applicable for hotel stays in the destination you are traveling to and are payable in local currency. Rates are subject to change without notice.

LIMITATION OF LIABILITY & RELEASE

Indelible Mark Travel will not be responsible for any physical or mental injury or loss (including property stolen, lost, or damaged) arising in connection with a client’s participation in a Indelible Mark Travel vacation, however caused.   Although Indelible Mark Travel makes every effort to ensure the supplier partners we have chosen are responsible partners, we are unable and do not have, control over them, and therefore cannot be responsible for their acts or omissions. The client agrees not to bring or maintain any legal action against Indelible Mark Travel, our employees, or agents in respect of any such injury, loss, or damage and release them from any such liability and any liability in respect of claims made against the client as a result of the client’s actions on a tour. The client acknowledges and agrees that Indelible Mark Travel or Nexion Canada, its directors, officers, shareholders, agents, successors, assigns, and independent contractors, shall not be liable or responsible for any claims, costs, damages, expenses, injuries or losses resulting from any Act of God, an act of war or terrorism, government or civil disorder, fire, flood, explosion, weather disaster, curtailment of transportation facilities, strike, lockout, delays, lost baggage or any other occurrence beyond its control that may lead to procedures imposed by the carriers, or any other unforeseen incident or circumstances.

COVID-19 PANDEMIC NOTICE

You understand the COVID-19 pandemic may impact and cause disruption to flights, hotels, or other portions of my travel plans.  You understand there may be extra procedures and policies to be followed in compliance at the arrival and departure airports, airlines, hotels, tours, and other elements of your travel plans.

Because of the worldwide effects of the Coronavirus, Covid-19, Indelible Mark Travel/Nexion Canada cannot provide any representations about any location or travel service that you are booking for yourself and everyone else who is a part of the booking.  You acknowledge that Covid-19 is active, worldwide, with associated health risks and restrictions that could, without warning, affect and cause significant disruptions, cancellations, and changes to any and all travel arrangements, by way of Covid-19 outbreaks, sudden border closures, quarantine, and lockdown orders, airport closures, government travel advisories, return-home directives, hospitalization for treatment and other similar consequences; and consequences not reasonably foreseeable at this time (collectively referred to as the “Covid 19 Risks”). 

Indelible Mark Travel is NOT responsible for any Covid-19 related travel incidences including but not limited to not being permitted to board the aircraft in any location, required quarantine or isolation, Covid-19 testing, etc, and any fees associated with them. In the event that some or all of the travel arrangements are cancelled, interrupted, or otherwise affected by the Covid 19 Risks, our rights and remedies shall be as determined and limited by the cancellation, rebooking, refund, and other policies and the terms and conditions of the supplier of the affected travel service, as set out in its brochures and/or websites. 

By asking Indelible Mark Travel to proceed with the travel arrangements booking, you voluntarily assume all risks related to exposure to COVID-19 and any other airborne viruses. While we do our best to provide you with up-to-date information, we cannot be liable if you become sick or contract COVID-19 during travel.  We recommend you assess your level of risk tolerance.  We recommend that you have professional advice as to your personal health condition and medical needs and you warrant that you and everyone who is a part of this booking is fit to travel.  Any travel insurance policy obtained may not include insurance coverage for travel service cancellations, interruptions financial, medical or other Covid 19 Risks, and all types of coverage must be confirmed with the travel insurer. We urge you to check the latest guidance from the Canadian government website at www.travel.gc.ca or your local Public Health Unit.

FORCE MAJEURE

Unforeseen events may be forces by “force majeure: to change or terminate your trip after departure but before the scheduled end of your time away. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our suppliers), pay you any compensation or meet any costs or expenses you incur as a result.

“force majeure” means any event which we or the supplier of the service(s) could not foresee or avoid. Neither Party will be liable for any failure or delaying performing an obligation that is due to any of the following causes, to the extent beyond its reasonable control: act of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalizes lack of availability of raw materials or energy.
